Appeals Court Keeps Trump’s 10% Tariff in Place
Here’s the legal whiplash, in plain English. On May 7, 2026, the U.S. Court of International Trade issued a divided 2-1 opinion holding that Trump’s 10% “temporary global tariff” imposed under Section 122 of the Trade Act of 1974 was unlawful. The court ruled that the statutory conditions required to invoke Section 122 weren’t satisfied, that the underlying presidential proclamation reflected an overly expansive interpretation of the authority Congress delegated, and that the balance-of-payments justification didn’t match what Congress had in mind. The decision granted a permanent injunction blocking collection of Section 122 duties, but only with respect to the plaintiffs: Burlap & Barrel, Basic Fun, and the State of Washington. Then 5 days later, on May 12, the Federal Circuit appeals court entered an administrative stay suspending the implementation of the CIT’s order while the appeal proceeds. The Customs & International Trade Law Blog covered the practical fallout: the tariff stays in effect, importers keep paying, and there’s no near-term refund pathway for non-plaintiffs. On top of that, the Section 122 tariff was always going to expire by its own terms on July 24, 2026, since the statute caps these tariffs at 150 days unless Congress extends them.
What this means on your store: if you’re sourcing from China, Vietnam, India, or anywhere else hit by the 10% global tariff, don’t bake a tariff drop into your Q3 pricing yet. I tell my clients to plan as if the 10% sticks until you see actual policy. The legal path is too uncertain, and even a favorable appeals ruling probably won’t unwind the duties retroactively for most importers. If you’ve been postponing supplier diversification, this is the quarter to find domestic and nearshore suppliers as a hedge.
TikTok Shop Replaces Violation Points With Account Health Rating
TikTok Shop confirmed via its official Latest Policy Updates feed that the Account Health Rating system rolls out for sellers and creators starting May 2026 and fully replaces the existing Violation Points system by July 2026. Sellers can preview their AHR score now and see how each shop action impacts it. New Official Creator and Marketing Creator accounts also enter an Early-Stage Pilot Program for at least 30 days with capabilities limited, including a posting cap of 3 e-commerce videos per day.
The shift matters because AHR is a continuous score rather than a discrete violation count. That means a shop with a clean Violation Points record could still see its AHR drop if it’s running aggressive launch tactics, low-quality creator content, or high return rates. On my stores, I’ve already seen the early signs: shops that recycled creator content from 2 or 3 different brands started getting flagged on the new AHR preview last week. If you’re on TikTok Shop, log in today, check your AHR preview, and clean up your content pipeline before July, when the new score becomes the only score that counts. Meta’s Advantage+ Creative Now Default + AI Disclosure Wave
Since February 2026, every new Sales, Leads, and App Promotion campaign in Meta Ads Manager launches with every Advantage+ Creative enhancement turned on by default, according to Audit Socials’ Meta Ad Policy 2026 Update Tracker. AI image adjustments, text variations, aspect ratio changes, AI dubbing, AI-generated music, persona-based image generation, all enabled out of the box. Combined with the March 2026 mandatory AI disclosure requirement on AI-generated or AI-modified ad creative, ad rejections are climbing, and skipping the disclosure step is one of the most common reasons accounts get flagged.
Under the hood, Meta’s Andromeda ranking system is now evaluating thousands of times more creative variants in parallel than its predecessor, shifting the primary performance lever from audience targeting to creative diversity. What that means for a small operator: if you’re running 2 to 3 creative variants per ad set and relying on lookalike audiences to do the heavy lifting, you’re behind. The new winning play is volume on the creative side, with disclosure metadata applied correctly so the AI-modified versions don’t get yanked.
AI: Google Tightens Spam Rules, Klaviyo Hooks Up Claude
Google Updates Search Spam Rules to Ban AI Manipulation
On May 15, 2026, Google updated its Search spam policies to explicitly cover attempts to manipulate generative AI responses in Search, including AI Overviews and AI Mode. This puts SEO operators on direct notice. If you’ve been running thin AI content farms, prompt injection tactics targeting AI Overviews, or any of the rank-manipulation playbooks designed to game generative answers, those tactics are now explicitly spam and subject to deindexing. The May 15 update lands on top of Google’s broader May 2026 algorithm work, which also added inline links, link previews, subscribed-publication highlighting, and Reddit-style community quotes to AI Overview responses. The net effect: Google is leaning harder into authoritative source signals and clamping down on AI manipulation at the same time. For brands building real content, this is good news. For thin-content arbitrage, it’s a clean shot across the bow.
Klaviyo Drops Agentic Workflows Powered by Anthropic Claude

Klaviyo’s Spring 2026 What’s New page also covers Custom Skills for the Customer Agent, RCS campaign support with product carousels and shop-now buttons, Next Best Product recommendations expanded to SMS, RCS, and WhatsApp, and personalized onsite banners powered by segment data.
For Klaviyo users this is a real lift. For everyone else, the bigger signal is that the ecommerce email platforms are all racing to bolt LLM-native workflows on top of customer data. The annual income threshold of around $60K USD remains, but compliance requirements are stricter. If you spend more than 183 days in Indonesia in a tax year on the E33G visa, you become a tax resident and your worldwide income can become subject to Indonesian tax. Mexico’s 2026 national budget includes a 100% increase in temporary and permanent residency visa fees, per Mexico News Daily’s coverage. One-year temporary permits jump from approximately $290 USD to $580. Four-year temporary permits go from $650 to $1,300. Permanent residency permits rise from $355 to $705. The practical impact is that Mexico is still cheap compared to Portugal, Spain, or Greece, but the cheap-and-easy era is closing. Step back and look across all 8 stories and a pattern is hard to miss. Every major platform and every major nomad-friendly government tightened something this week. Shopify killed a free competitive tool. Amazon contracted 3P share. TikTok Shop introduced a tighter scoring system. Meta defaulted creative AI on while requiring disclosure. Google clamped down on AI content manipulation. Portugal doubled the citizenship clock. Indonesia tightened compliance. Mexico doubled fees. Most US-based operators I work with run a Wyoming, Delaware, South Dakota, or New Mexico LLC paired with whichever country gives them the best lifestyle and tax setup. That stack still works. It just requires more deliberate planning now.
The synthesis: the era of easy is closing on both sides of this audience. The good news is that the operators who plan deliberately, who pick their platforms with intention, who form their entities cleanly, and who pick their residency strategically are going to compound a real advantage over the operators still treating these decisions as afterthoughts.

Yes, if your goal is comfortable residency in the EU with reasonable tax treatment. The D8 still grants legal residency, freedom to travel within Schengen, and access to Portuguese healthcare.
